A clear agreement for shared rescue work.

Agreement

These Terms of Service form an agreement between Kafure Consulting, which operates Paware (“Paware,” “we,” or “us”), and the person or organization using Paware (“you”). They cover the Paware application, hosted rescue websites and forms, subscriptions, and connected services. By creating an account, accepting a team invitation, or using Paware, you agree to these terms and our Privacy Policy.

If you use Paware for an organization, you also agree on that organization's behalf and confirm that you have authority to do so. A written agreement signed by both parties controls if it expressly conflicts with these online terms.

Accounts and authority

You must be at least 18 and legally able to enter this agreement. Provide accurate account information, protect your password and recovery methods, and use your own sign-in rather than sharing credentials. Tell us promptly about suspected unauthorized access.

Organization owners control team invitations, roles, billing, connected services, exports, and organization deletion. Team members must use only the access their organization has granted. Paware may suspend an account or action when reasonably necessary to protect the service, an organization, a person, or an animal.

Rescue data

Your organization keeps ownership of the information and files it puts into Paware. You give Paware a limited permission to host, copy, process, translate, transmit, format, and display that information only as needed to provide, secure, support, and improve the service and to follow the organization's authorized instructions.

Your organization is responsible for having an appropriate reason and any required notice or consent to collect and use information about applicants, adopters, donors, volunteers, staff, fosters, veterinarians, transporters, visitors, and other people. This is especially important for identity documents, medical or safety notes, household information, children's ages, financial records, and other sensitive data. Do not make private information public through a website, document, or listing unless you are authorized to do so.

Paware provides operational records and workflow tools, not legal, accounting, tax, medical, or veterinary advice. Your organization is responsible for its decisions, contracts, receipts, animal care, and compliance obligations.

Trials, subscriptions, and complimentary access

Unless a different offer is shown, a new organization receives a 30-day trial without a card. The Paware Foundation plan is $30 USD per organization per month after the trial. Stripe handles checkout, payment methods, and invoices. Applicable taxes may be added.

Subscriptions renew until canceled. You may cancel from the service; access continues through the paid-through date. Failed payments may receive a seven-day grace period. After access ends, the workspace may become read-only, the public website may remain available for a 30-day safety period, and organization data is normally retained for 90 days before deletion. The current status and dates shown in Settings control for the organization.

Paware may grant complimentary access with no payment or expiration. A complimentary grant does not change these terms and may be changed or ended with reasonable notice unless we agree otherwise in writing. Price changes will apply prospectively after advance notice.

Connected services

An authorized owner or administrator may connect third-party services such as Google Calendar, Stripe, listing providers, email, or domains. By connecting one, the organization instructs Paware to exchange the information needed for that feature and confirms it may authorize the third-party account.

Third-party services have their own terms, availability, and privacy practices. Paware is not responsible for their systems or for changes they make. You may disconnect an integration, but information already delivered to the other service may remain there. For Google Calendar, see our connection details.

Managed websites, forms, and domains

Paware can publish organization-approved records and content to an included paware.pet address or a connected custom domain. The organization is responsible for the accuracy, rights, accessibility, and legality of its published content, links, fundraising claims, forms, photographs, trademarks, and domain use.

A custom domain remains the organization's property and must be maintained with its registrar. Ending Paware does not transfer the domain to us. We may temporarily remove content or a domain connection that creates a security risk, infringes rights, violates law, or materially harms the shared platform.

Acceptable use

You may not use Paware to:

• Break the law, facilitate abuse, or endanger a person or animal.
• Access another organization's workspace or information without authorization.
• Upload malware, probe or bypass security, overload the service, or interfere with another user.
• Send unlawful or deceptive messages, impersonate others, or publish content you do not have the right to use.
• Resell access, reverse engineer protected parts of the service, or use automated extraction except through an interface we provide or authorize.

We will use proportionate measures and, when practical, provide notice and an opportunity to correct a problem before restricting access.

Ownership

Paware and its software, design, documentation, and brand are owned by Kafure Consulting or its licensors. These terms give you a limited, non-exclusive, non-transferable right to use the service while your account is authorized. They do not transfer our intellectual property. Your feedback may be used to improve Paware without an obligation to compensate you.

Availability and changes

We work to keep Paware dependable, but maintenance, internet failures, third-party outages, emergencies, and evolving provider rules can interrupt features. We may improve, replace, or discontinue a feature. When a material change would significantly reduce a paid organization's core service, we will provide reasonable notice when circumstances allow and preserve a practical export path.

Warranties

To the maximum extent allowed by law, Paware is provided “as is” and “as available.” We disclaim implied warranties of merchantability, fitness for a particular purpose, non-infringement, and uninterrupted or error-free operation. We do not guarantee adoption outcomes, fundraising results, regulatory compliance, message delivery, or the conduct of organizations, team members, applicants, or third-party providers. Rights that cannot legally be disclaimed remain in effect.

Liability

To the maximum extent allowed by law, neither Paware nor Kafure Consulting will be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, revenue, goodwill, or data, arising from the service. Our total liability for claims relating to Paware will not exceed the greater of US$100 or the amount the organization paid Paware during the 12 months before the event giving rise to the claim. These limits do not apply where law prohibits them.

Governing law

These terms are governed by Florida law, without regard to conflict-of-law rules. Any dispute that cannot be resolved informally will be brought in the state or federal courts located in Miami-Dade County, Florida, unless applicable law requires another forum. Before filing, each party agrees to give the other a reasonable written description of the issue and 30 days to try to resolve it.

If any provision is unenforceable, the rest remains effective. A failure to enforce a provision is not a waiver. You may not assign this agreement without our consent; we may assign it as part of a merger, acquisition, reorganization, or sale of the service.

Changes to these terms

We may update these terms as the service or law changes. We will change the date above and provide advance notice in the service or by email for material changes. Continued use after the effective date means you accept the updated terms. If you do not accept a material change, you may stop using Paware and export organization data before access ends.
